Tutor Fish – Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of services provided by Covington & Covington, Inc. D.B.A. Tutor Fish (“Tutor Fish,” “we,” “us,” or “our”). By purchasing credits, booking sessions, submitting forms, or participating in any Tutor Fish service, you (“Client,” “Parent,” or “You”) agree to be bound by these Terms in full.
If you do not agree to these Terms, do not purchase credits, book sessions, or use our services.
1. Services Provided
Tutor Fish provides the following services exclusively:
One-on-one virtual tutoring
Intake assessments, including Personalized Learning Reviews
Homeschool evaluation assessments
Educational assessments and skill reviews
Virtual summer camps
Tutor Fish does not provide advocacy services, legal services, therapy, medical services, or diagnostic evaluations.
2. No Academic Guarantees
Tutor Fish makes no guarantees regarding:
Academic improvement
Grades
Test scores
Graduation outcomes
College acceptance
Scholarship eligibility
Behavioral or emotional outcomes
Educational progress depends on factors outside our control, including student effort, attendance, and external conditions.
3. Credit-Based Payment Model
3.1 Credit Purchases
All services require pre-purchased credits
Credits must be purchased before booking
Credits represent the right to schedule time, not a guarantee of availability
3.2 Refund Policy (IMPORTANT)
All credit purchases are non-refundable by default
Tutor Fish does not provide cash refunds for purchased credits under normal circumstances
Credits are not refundable for:
Unused time
Expiration
Scheduling conflicts
Dissatisfaction
Technical issues outside our control
At our sole discretion, Tutor Fish may issue a refund in rare or exceptional circumstances
Any such refund is not guaranteed and does not establish a precedent for future refunds
3.3 Expiration
Credits may expire if unused within a specified timeframe. Expiration terms, if applicable, will be disclosed at purchase.
4. Step Up For Students (Scholarship Funds)
Tutor Fish may accept Step Up For Students (SUFS) funds in lieu of private payment.
Tutor Fish is not responsible for:
Denied allocations
Delayed payments
Funding changes
Compliance decisions by scholarship administrators
If scholarship funds are revoked, delayed, or denied, the Client remains financially responsible for services rendered unless otherwise stated in writing.
5. Scheduling, Attendance, and Cancellations
5.1 Booking
Sessions are first-come, first-served
Availability is not guaranteed
5.2 Cancellation Policy
Sessions must be canceled at least 24 hours in advance
Late cancellations (<24 hours) result in forfeited credits
No-shows automatically forfeit credits
5.3 Tutor Cancellations
If Tutor Fish cancels a session, credits will be returned or rescheduled.
6. Intake & Assessment Services
All assessments are informational only and do not constitute:
Medical or psychological diagnoses
Legal determinations
Guaranteed academic outcomes
7. Parent & Client Responsibilities
Clients agree to:
Provide accurate information
Ensure student attendance
Maintain appropriate behavior
Provide a working device and internet connection
Supervise minors as appropriate
Tutor Fish may suspend or terminate services for misconduct.
8. Communication & SMS Terms
By using Tutor Fish services, you agree to receive service-related communications from Tutor Fish by email, phone, or other contact methods you provide. These communications may include scheduling confirmations, session reminders, service-related updates, account notices, and customer support messages.
8.1 SMS Messaging
Tutor Fish may send SMS messages only to users who have explicitly opted in.
End users may opt in by texting START to Tutor Fish’s SMS number at (850) 329-5355 after viewing Tutor Fish’s SMS opt-in instructions. By texting START, you agree to receive recurring non-promotional, service-related SMS messages from Tutor Fish.
SMS messages may include tutoring appointment reminders, scheduling confirmations, scheduling changes, customer support responses, account-related notifications, and other service-related communications.
Message frequency varies based on scheduled services and account activity. Message and data rates may apply.
You may opt out at any time by replying STOP. You may request assistance by replying HELP or by contacting Tutor Fish at info@tutorfish.net.
Consent to receive SMS messages is not a condition of purchasing services from Tutor Fish.
Tutor Fish does not send promotional or marketing text messages through this SMS campaign.
9. Intellectual Property
All materials provided remain the property of Tutor Fish.
Unauthorized reproduction or distribution is prohibited and may result in termination and legal action.
10. Limitation of Liability
To the fullest extent permitted by Florida law:
Tutor Fish is not liable for indirect or consequential damages
Liability is limited to the amount paid in the preceding 30 days
We are not responsible for third-party platform failures
11. Indemnification
You agree to indemnify Tutor Fish against claims arising from:
Misuse of services
Violations of these Terms
Actions of the student or parent
12. Termination of Services
Tutor Fish may suspend or terminate services at any time.
Termination may occur with or without notice
Unused credits are forfeited upon termination
13. Governing Law
These Terms are governed by the laws of the State of Florida.
14. Modifications
We may update these Terms at any time. Continued use constitutes acceptance.
